Police responded around 3:20 a.m. on a report of shots fired. A witness to that shooting reportedly said that a dark car fled. A short time later, officers said they spotted Pena's car, a black Cadillac, and they attempted a traffic stop, but he sped away. Pena drove onto the median then ran from his car and hopped a fence. The officers pursued on foot, pushed down a fence to get to the man and shot and killed him.
